Source: EU-Coke Antitrust Deal in Works
BRUSSELS (Reuters) - The European Commission plans to announce a formal proposal settling the long-running Coca-Cola antitrust case later on Tuesday, a source close to the situation said. The proposal will be very similar to a tentative agreement reached by Coke and the EU executive in September, a second source familiar with the situation said. The proposal will be published in the Commission's official journal, allowing others such as PepsiCo to comment in coming weeks. "We're awaiting guidance from the Commission," a spokesman for Coke said, declining comment on the settlement. A spokesman for Pepsi said the company would have no comment until it saw the final proposal. The Commission had said Coca-Cola made it hard or impossible for other drinks firms to get a toehold in the market by offering retailers incentives to give its flagship Coke and other drinks prominent placing on their shelves. The tentative agreement reached in September required Coca-Cola to stop giving rebates to stores for grouping Coke and the firm's less popular drinks together. An informal review of that agreement by customers and competitors has now been completed. That informal review resulted in some fine tuning of the deal but no major changes were made, the source said. At one point, some large European retailers told the Commission they feared the agreement could cost them money.
